Each year about 3 million people end up owing money to the IRS they cannot immediately pay. When a tax becomes delinquent, the liability creates a “lien” in favor of the federal government that attaches to “all property and rights to property.” When the IRS files a Notice of Federal Tax Lien, the fact of the liability becomes public record, and the negative effects are profound. Individuals lose the ability borrow money or even refinance an existing loan, credit scores often plummet, and existing loans may even be called due. Businesses also lose borrowing borrow and regularly face revocation of existing lines of credit by banks and suppliers. The lien creates an egregious Catch-22 situation, in that one must borrow money to pay off the lien, but cannot borrow money because of the lien. The good news is that there are very specific procedures in the Internal Revenue Code and IRS regulations that allow tax professionals to navigate the dangerous world of federal tax liens.

• Statutory and non-statutory guidelines for the filing of federal tax liens

• Statutory grounds for the release of federal tax liens
• The procedures for lien releases, withdrawals and subordinations
• Dealing with erroneous lien filings
• Understanding key rules for winning the withdrawal of federal tax liens, including hardship issues and the “facilitation of tax collection”
